The procedure for tenants who wish to exercise the option to renew the lease agreement or emphyteutical deed, requires the tenant to compile and submit certain documentation which is required to determine whether the tenant is compliant with the terms and conditions of the agreement and to verify that the premises have been kept in good condition and repair.

With reference to documents being requested relating to matters of compliance these are to be submitted in the form of a report, which is to be compiled and certified by a warranted Auditor which is to include the following:

  1. A description of the tenants’ utilisation of the whole area of the premises and the type of activity that is being carried out on the premises supported with photographs.
  2. A list of the employees which are currently being employed by the tenant which is to be issued from Jobs plus.
  3. An overview regarding the mode and amount relating to current rent payments with respect to the occupation of the premises.
  4. A review regarding the investment that the Company has undertaken in relation to plant and machinery and/or any structural investment to the premises and if any other investment is planned.
  5. The updated insurance documents in terms of the agreement to confirm that the premises are adequately insured.
  6. If the tenant is a company, a good standing certificate issued by the Malta Business Registry is to be submitted including confirmation that the company has not been and is not in the process of being dissolved, struck off, or wound up. If the tenant is not a company, a declaration or certificate issued by an Auditor is to be submitted which confirms that the tenant is not an undischarged bankrupt and is solvent.


With reference to documents requested relating to the condition and repair of the premises, these are to be submitted in the form of a condition report and is to be compiled and certified by a warranted Architect and Civil Engineer which is to include the following:

  1. To establish a visual structural condition of the building and respective finishes of the said premises supported with photographs;
  2. A description of the area of the premises;
  3. A checklist which summarises the condition relating to the surrounding area, interior elements and fire/light safety, indicating if it is in an excellent, good, fair or poor condition;
  4. Information regarding the age of premises, if it is a detached or semi-detached, terraced, basement with boundary or basement property, and to establish if the property has a concrete roof or pitched;
  5. To determine that the premises is acceptable for the permitted use;


All documents submitted shall be in original form. Documents which are not in original must be duly certified. Certification of documents shall be evidenced by a written statement which must state that the document is a true copy of the original documents seen by the person certifying it.
